Mine industry has been giving a significant
contribution in Indonesian economic
development, it has openned daerah tertinggal
and absorb local workers.
In the year of 2004, mine industry had
contributed 2,8 % of the total of Indonesian GNP,
which also contributed in absorbing 35,000
workers. However, mine industry also presenting
pros and cons related to issues such as
environmental management, protection on
traditional communities (particularly on hak
ulayat) and state income.
By the end of 2008, government and house of
representatives have approved the bill of new
mining law, so called as Law No. 4 Year of 2009
(”mining law”). The issues are arising due
transitional provision (article 169) which
regulates that the existing contract of work and
Coal Mining Exploitation Working Arrangement
have to adjust with this Law by not later than 1
(one) year after the enactment of new mining
law. This provision leaves questions regarding
legal certainty to mining industry’s actors, legal
substances of adjustment in the contract shall
be made between parties. |
